These Terms of Service ("Terms") govern access to and use of RivusMind ("the Service"), a private, internal business-analytics application operated by AEC Enterprises, LLC. The Service is provided for internal business use by our authorized personnel only. By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
The Service
RivusMind consolidates and analyzes business, advertising, sales, inventory, and financial data from platforms on which we hold accounts, and presents reporting and analytics for internal decision-making. The Service is not a public product and is not offered or sold to third parties.
Eligibility and authorized use
Access is limited to individuals we have authorized. You must be authorized by AEC Enterprises, LLC and comply with any access controls we put in place. You are responsible for maintaining the confidentiality of your credentials and for all activity under your access.
Acceptable use
You agree not to use the Service for any unlawful purpose or in violation of these Terms; to attempt to gain unauthorized access to the Service, its data, or its systems; to interfere with or disrupt the integrity or performance of the Service; or to use the Service in a manner that violates the terms of any connected third-party platform.
Third-party services and data
The Service integrates with third-party platforms (such as Amazon, Shopify, Meta, and Google). Access to those platforms is governed by their respective terms and policies and by authorization you or the account holder grant. Use of Google APIs is additionally subject to the applicable Google API Terms of Service and the Google API Services User Data Policy. Our handling of information is described in our Privacy Policy.
Intellectual property
The Service, including its software, design, and content, is owned by AEC Enterprises, LLC or its licensors and is protected by applicable law. These Terms do not grant any ownership rights in the Service.
Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that analytics produced by it are accurate or complete.
Limitation of liability
To the maximum extent permitted by law, AEC Enterprises, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to the use of the Service.
Indemnification
You agree to indemnify and hold harmless AEC Enterprises, LLC from claims arising out of your misuse of the Service or violation of these Terms.
Termination
We may suspend or terminate access to the Service at any time, with or without notice, including for violation of these Terms. Provisions that by their nature should survive termination will survive.
Governing law
These Terms are governed by the laws of the jurisdiction in which AEC Enterprises, LLC is established, without regard to conflict-of-laws principles.
Changes
We may modify these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance.
